1. Introduction

Welcome to GeneaHub. By accessing and using our platform, you agree to these Terms of Use in their entirety. GeneaHub is a non-profit project created by and for the genealogical community, with the aim of connecting researchers who need archival documents with volunteers willing to help.

2. Express Prohibition of Commercial Use

The commercial use of GeneaHub is STRICTLY PROHIBITED. This includes, but is not limited to:

  • Resale of documents: Selling, marketing, or charging for documents obtained through the platform.
  • Covert professional services: Using GeneaHub to perform paid professional genealogical research work, either directly or indirectly.
  • Commercial intermediation: Acting as a commercial intermediary between applicants and volunteers and charging commissions or fees.
  • Customer acquisition: Using the platform to attract customers for paid genealogical services.
  • Advertising: Promoting commercial services, whether your own or those of third parties.

Consequences of non-compliance:

Violation of this policy will result in immediate and permanent suspension of the account, without the possibility of appeal. We reserve the right to take legal action if fraudulent commercial use is detected.

3. Nature of the Service

GeneaHub is a platform for connecting people with common genealogical interests. We are not a genealogical research service, but rather a meeting place for the community.

  • Volunteers act altruistically and without contractual obligation.
  • We do not guarantee results or the retrieval of specific documents.
  • The quality and accuracy of the documents obtained depends on the volunteers.
  • We do not verify the authenticity of the documents shared.

4. Expected Conduct

By using GeneaHub, you agree to:

  • Provide truthful information about yourself and your requests.
  • Treat all users with respect and courtesy.
  • Not abuse the request system or the generosity of volunteers.
  • Respect the time and availability of volunteers.
  • Appreciate and fairly value the help received.
  • Do not share other users' personal data without their consent.
  • Report any inappropriate or suspicious behavior.

5. Reputation System

GeneaHub uses a reputation system based on mutual ratings between users. This system aims to:

  • Foster trust among community members.
  • Reward the most active and collaborative users.
  • Identify problematic behavior.

Ratings must be honest and constructive. False or malicious ratings will be grounds for punishment.

6. Intellectual Property

Historical documents obtained through GeneaHub are subject to their own public domain and archival rights regulations. The user is responsible for:

  • Verifying the terms of use for each document.
  • Respecting the regulations of the source archives.
  • Properly citing sources in publications.

7. Limitation of Liability

GeneaHub is provided ‘as is’ and ‘as available’. We are not responsible for:

  • Errors or omissions in documents provided by volunteers.
  • Disputes between users of the platform.
  • Loss of data or service interruptions.
  • Decisions made based on the information obtained.

8. Your Rights as a User

As a GeneaHub user, you have the right to:

  • Access and export your data: You can download all your information in JSON format from your profile.
  • Rectify your information: You can edit your personal data at any time.
  • Delete your account: You can request the complete deletion of your account and associated data from the privacy settings.
  • Portability: Your data can be exported and transferred to another service.

9. Suspension and Termination

We reserve the right to suspend or terminate your account if:

  • You violate these Terms of Use or the Code of Conduct.
  • You engage in unauthorized commercial activities.
  • You abuse the system or other users.
  • You provide false or misleading information.
  • You engage in illegal activities through the platform.

Suspensions may be temporary or permanent depending on the severity of the violation. In cases of permanent suspension, we will retain your data for 30 days to allow for appeals, after which it will be deleted in accordance with our retention policy.

10. Modifications to the Terms

We reserve the right to modify these terms at any time. Significant changes will be notified to registered users by email at least 15 days in advance. Continued use of the platform after the changes implies acceptance of the new terms. If you do not agree with the changes, you can delete your account before they take effect.

11. Applicable Law and Jurisdiction

These Terms of Use are governed by Spanish law and, in particular, by:

  • General Data Protection Regulation (GDPR) of the European Union
  • Organic Law 3/2018 on Personal Data Protection (LOPDGDD),
  • Law 34/2002 on Information Society Services (LSSI),

For any dispute that may arise, the parties submit to the Courts and Tribunals of the user's domicile, expressly waiving any other jurisdiction that may apply to them.
